Your Step-by-Step Guide to Buying a Home and Navigating Conveyancing

Embarking on the journey to buy a home can feel daunting, but with the right guidance, it becomes an exciting adventure. This comprehensive guide will walk you through every crucial step, from initial search to receiving your keys, ensuring a smooth and confident path to homeownership.

Buying a home is one of life's most significant milestones. As a family-run, independent estate agency established in 1977, Church & Hawes has been selling homes in Essex ever since. We understand the intricacies of the market and are here to provide you with a clear, step-by-step roadmap to homeownership, combining traditional agency values with cutting-edge technology.

Step 1: Financial Preparation and Mortgage Pre-Approval

Before you even start browsing properties, understanding your financial position is paramount. How much can you realistically afford? This involves assessing your income, outgoings, and savings for a deposit. It's highly advisable to speak with a mortgage advisor or broker at this stage. They can help you secure a 'mortgage in principle' (also known as an Agreement in Principle or Decision in Principle). This document confirms how much a lender is willing to lend you, subject to a full application and valuation. It not only gives you a clear budget but also demonstrates to estate agents and sellers that you are a serious and credible buyer, giving you a significant advantage in a competitive market. If you are a cash buyer, you will need to provide proof of funds.

Step 2: The Property Search – Finding Your Dream Home

With your finances in order, the exciting part begins: finding your new home! Consider what's important to you: location (Countryside homes, or perhaps a bustling town centre), property type, number of bedrooms, garden size, and proximity to schools or transport links. Utilise online property portals, but don't underestimate the value of registering with local estate agents like Church & Hawes. Our local multi-office network means we often have 'heads up' properties that haven't yet hit the open market. You can explore these exclusive opportunities at CLICK HERE. Our long-serving staff possess unrivalled experience and local knowledge, providing invaluable insights into specific areas and property values.

Step 3: Making an Offer and Offer Acceptance

Once you've found a property you love, it's time to make an offer. You will need to supply proof of funds and once received your estate agent will submit the offer to the seller on your behalf. It's not just about the price; you might also specify conditions such as a desired completion date or inclusion of fixtures and fittings. If your offer is accepted, congratulations! The property will then be marked as 'Sold Subject to Contract' (SSTC). This is a crucial moment, but remember, until contracts are exchanged, either party can still pull out. At this stage, anti-money laundering (AML) checks will need to be completed by your estate agent and conveyancer to comply with legal requirements. This involves verifying your identity and the source of your funds, ensuring a transparent and secure transaction. (Administration costs may apply for these checks).

Step 4: Appointing a Conveyancer

This is where the conveyancing process truly begins. Conveyancing is the legal process of transferring ownership of a property from one person to another. You'll need to appoint a solicitor or licensed conveyancer to handle this. They will conduct searches, deal with legal paperwork, and ensure the property title is sound. Choose a conveyancer known for their efficiency and clear communication, as this can significantly impact the speed and smoothness of your transaction. Our low sale fall-through rates are partly due to our proactive collaboration with reliable conveyancers. Church & Hawes can provide recommendations.

Step 5: Mortgage Application and Valuation

Following your accepted offer, you'll proceed with your full mortgage application. Your lender will arrange a valuation of the property to ensure it provides sufficient security for the loan. This valuation is for the lender's benefit, not yours. This step is not required if you are buying with cash. You may also wish to arrange your own independent survey (e.g., a HomeBuyer Report or a Building Survey) to uncover any potential structural issues or significant defects before you commit to the purchase. A building survey is still highly recommended even for cash buyers.

Step 6: Searches and Enquiries

Your conveyancer will carry out various searches with local authorities and other bodies. These typically include:
  • Local Authority Searches: Revealing planning permissions, building control issues, and road schemes.
  • Environmental Searches: Checking for contaminated land, flood risk, and ground stability.
  • Water and Drainage Searches: Confirming connections to public sewers and water mains.
  • Chancel Repair Liability Search: Determining if the property is liable for church repair costs.
They will also raise enquiries with the seller's solicitor, asking for clarification on any aspects of the property or title that are unclear.

Step 7: Reviewing the Contract and Reports

Once all searches are back and enquiries answered, your conveyancer will provide you with a detailed report on their findings, along with the draft contract. It is vital that you read these documents thoroughly and ask any questions you have. This is your opportunity to understand exactly what you are buying and any potential liabilities.

Step 8: Exchange of Contracts

When both parties are satisfied, and your mortgage offer is firmly in place, you will sign the contract, and your conveyancer will exchange contracts with the seller's solicitor. At this point, you will typically pay your deposit (usually 10% of the purchase price). Crucially, once contracts are exchanged, the agreement becomes legally binding, and neither party can pull out without incurring significant penalties. A completion date is also set at this stage.

Step 9: Pre-Completion and Final Checks

Between exchange and completion, your conveyancer will finalise all legal and financial arrangements. This includes requesting the mortgage funds from your lender and preparing the transfer deed. You might also conduct a final visit to the property to ensure it's in the agreed condition.

Step 10: Completion Day!

This is the day you've been waiting for! On completion day, your conveyancer transfers the remaining funds to the seller's solicitor. Once the seller's solicitor confirms receipt, the property officially becomes yours. Your estate agent/vendor will then release the keys to you. Congratulations, you are now the new homeowner!
